Fiancee Visas for the
US
If you are a US
citizen planning to marry someone who is not a US
citizen in the United States, your fiancé(e) will need a
visa to enter the United States. Specifically, you will
need a K-1 visa, which will allow
you to get married and then pursue permanent
residency.
Applying for the K-1 Visa
To apply for the K-1 visa, the
procedure is as
follows: |

- Form I-129F Petition for Alien Fiancé(e) should
be submitted to USCIS. If your fiancé(e) has unmarried
children who are under 21, they are eligible to accompany
your fiancé(e), but only if they are listed on this
form. Show proof of your U.S. citizenship.
- Submit 2 Form G-325A Biographic Data Sheets (one
for you and one for your fiancé(e)) plus
color photos of each of you.
- A copy of any divorce decrees, death
certificates, or annulment decrees if either of you were
previously married.
- Proof of permission to marry if you or your fiancé(e)
are subject to any age restrictions (age restrictions vary
from state to
state).

You and your fiancé(e)
must fulfill several requirements in order
to be considered for the K-1 visa, such
as:
- You must both be free to marry (ie both of you are
single, divorced, etc)
- You must have met your fiancé(e) in person at
least one time in the past two years. You can prove this by
showing photographs of the two of you together, airline
tickets, etc. This can be waived if you can prove that
meeting would have created hardship, or meeting would have
gone against traditional or cultural custom in your
fiancé(e)'s home country.
- It is important to note that if your fiancé(e) is given
the visa, you must get married within 90 of his or her
arrival in the US, or your fiancé(e) will have to leave.
Your fiancé(e) may not be given another US visa if this
happens. The visa cannot be extended beyond 90 days. Your
fiancé(e) also must marry the K-1 petitioner (you) and no
one else in order to remain in the
US.

Fiancee Visas for Britain (incl. EU
Citizen)
The requirements for immigration to UK
as a Fiancé/e’s are very similar to the rules for married
couples. You may wish to consider very carefully whether it
is best to marry first and then apply for entry as this will
avoid the necessity of making a fiance/e application and
then a second application to remain as a spouse. However,
please note that it is no longer possible for most
visitors to change status to a spouse visa. The
basic requirements for immigration to UK are as follows:
- Unless you are engaged to an EU Citizen (not
British citizen in this situation!) with a five year
residence permit you must apply for entry from outside the
UK. If you wish to apply from within the UK in
other circumstances your application is likely to be
refused unless you can show exceptional reasons why the
application should be granted.
- You are granted entry to the UK for a period of six
months during which time you must marry your fiancé/e in
the UK. If there are exceptional reasons for delaying
marriage until after the initial six months an extension
to stay in the UK may be granted.
- You will not be permitted to work in the UK on the
fiance/e visa, and you and your fiance/e must show that
there will be sufficient funds and accommodation in the UK
without requiring public funds before and after the
marriage. Public funds cover various benefits paid by the
Government if you are currently looking for work, if you
are on a low income and if you are in various other
situations.
- You must have met your future spouse. This is to
prevent a situation that occurs sometimes in arranged
marriages where the future husband and wife have never
met.
- You must intend to live together permanently with your
future spouse once you are married.
- It is a requirement that the overseas fiancé/fiancée
has to be 16 years old or over, and the sponsor in the UK
has to be at least 18 years old.
- Children of the overseas fiance/e who are under 18
years old are only allowed entry to the UK as dependants
if it can be shown that it would cause serious problems if
they are not allowed entry at the same time. Therefore
this sort of application will be difficult to make, and in
many cases it may be best to wait until after the marriage
and then apply for entry of dependents.
- You should apply for a marriage visa from within the
UK when you are married, and will then be eligible to work
freely in the UK.

Fiancee Visas
for Australia
Prospective Marriage (also known as the Fiancee Visa)
This visa is available to a person who is overseas who
wants to come to Australia to marry a person who also agrees
to be their sponsor. When granted the visa is valid for 9
months, during which time the applicant must marry the
sponsor and apply for the spouse visa if he or she wishes to
remain in Australia.
The applicant must:
Have physically met the Australian sponsor, and
Be engaged to be married to the Australian sponsor in
Australia (details will usually be required to confirm
arrangements, etc), and
Marry the Australian sponsor within 9 months of entering
Australia, and
Intend to live with the sponsor after marriage in a
genuine spousal relationship, and
Apply for the spouse visa within the period of the visa.
Note that this visa can only be applied for
outside Australia, and that there are no provisions
allowing an individual who is already in Australia on
another category of visa to extend their stay in
anticipation of marriage. Such a person would be required to
marry their fiance(e) before their visa expired, and to
apply for the spouse visa.
Interdependency This category of
visa is designed to cater for same-sex couples. The
application criteria and procedures are as for the spouse
visa whereby a temporary visa will be issued initially,
followed by a permanent visa if the relationship is assessed
as genuine and on-going after 2 years from the date of the
application.
